OPINION

STANLEY S. HARRIS, District Judge.

Now before the Court is defendants’ motion to dismiss or, in the alternative, for summary judgment. For the reasons set forth below, defendants’ motion is granted in part and denied in part. 1

The following facts have been taken from the amended complaint. 2 In May 1980, plaintiff was hired for a GS-13, Schedule A position on the Chrysler Loan Guarantee Board (CLGB) staff at the United States Department of the Treasury (Treasury).
