Plaintiff in error was fined $250 in the District Court of Adams county, for contempt, for a refusal to' testify before a grand jury, and this cause is now before us on his application for a supersedeas.
December 17, 1918, Judge Class, of the First Judicial District, presiding in the District Court of Adams county, and acting upon a request of the District Attorney of that district, called a grand jury to meet December 26, 1918, *180on which date the body was regularly impaneled, sworn and instructed.
