MEMORANDUM OPINION
PAYNE, District Judge.
This action arises out of the decision by the County of Henrico, Virginia (the “County”) to approve a private developer’s preliminary plans to construct a regional shopping center in the County and near the intersection of Interstate Highways 64 (“1-64”) and 295 (“1-295”). The Plaintiffs, the Taubman Realty Group, Limited Partnership (“Taubman”) and TRG-Regency Square Associates, LLC (“TRG”), are competing shopping center developers.
