Appellant Kenneth Mauder (“Mauder”) appeals from the district court’s grant of summary judgment in favor of the defendant-appellee Metropolitan Transit Authority of Harris County, Texas (“Metro”). Mauder states that the district court erred in its grant of summary judgment because (1) he presented sufficient evidence that he suffers from a serious health condition, and, therefore should have been granted temporary leave under the Family and Medical Leave Act (“FMLA”) to take necessary bathroom breaks; and (2) Metro’s termination of his employment was done in…
