OPINION OF THE COURT

FLAHERTY, Justice.

This is an appeal, by allowance, from a memorandum opinion and order of the Superior Court which affirmed an order of the Court of Common Pleas of Fayette County upholding the validity of a transfer in ownership of a certain bank account 392 Pa.Super. 660, 564 A.2d 267. At issue is whether the transfer of the bank account, by an elderly man and his wife, was attributable to undue influence, fraud, or lack of mental capacity.
