This is an appeal from an order refusing to recall and set aside an execution. The judgment upon *474which the' execution was issued has been affirmed by this court. (Herrlich v. McDonald, ante, p. 460.) The ground upon which the motion to recall the execution was made, if there was such a motion, seems to have been that the defendant had been discharged in insolvency. The record on this appeal is in an anomalous condition. It appears that a notice was given that on a certain day a motion would be made to recall and set aside the execution on certain grounds stated, but no such motion appears in…
