The cases that make up this consolidated appeal come to us through different procedural routes. In Docket No. 214504, this Court granted defendant National Surety Corporation’s (hereinafter ffic) application for leave to appeal the trial court’s September 1, 1998, opinion and order granting partial summary disposition to plaintiff and denying ffic’s motion for summary disposition.
