In January 1999, the City of Malvern submitted an application to the Arkansas Soil and Water Conservation Commission (“Commission”) seeking a determination of compliance with the Arkansas Water Plan. The water development project for which the City sought approval (hereinafter “Malvern Project”) was developed through the joint efforts of the City of Malvern, the Salem Water Users Association, the Southwest Water Users Association, and the Town of Tull.
