CUDAHY, Circuit Judge.

Vladimir Cedano-Rojas (Cedano) was indicted on one count of conspiracy to distribute ten kilograms of cocaine and one count of possession with intent to distribute one kilogram of cocaine as a result of a “reverse-buy” undercover operation. After a jury trial, Cedano was acquitted on the conspiracy charge but convicted on the possession count. At the sentencing hearing, the court determined that nine kilos of cocaine under negotiation at the time of the arrest should be used in calculating Cedano’s base offense level.
