COFFEY, Circuit Judge.

On August 18, 1994, a federal grand jury-charged the defendant, James P. Hickok, with one count of conspiracy to commit mail fraud, in violation of 18 U.S.C. § 371, and two counts of mail fraud, in violation of 18 U.S.C. § 1341. Hickok entered a plea of not guilty to all three charges, and a jury trial commenced on November 7, 1994.
