In October 2002, a Smith County jury, after hearing evidence, found appellant guilty of the capital murder of James Sy-vertson. See Tex. Pen.Code § 19.03(a)(2). That same jury, after hearing additional evidence, answered three statutory special issues 1 in such a way that the trial court was required to assess appellant’s punishment at death.
