This appeal is from a district court order that denied appellant city’s motion to dismiss for lack of subject-matter jurisdiction respondents’ lawsuit challenging the city’s building-permit fees. The city argues that (1) because each of respondents’ claims addresses the application and interpretation of the state building code, and an administrative process is available to address these matters, the district court erred in ruling that respondents did not need to exhaust administrative remedies before seeking judicial review; and (2) the municipal planning act does not…
