OPINION

CLAY, Circuit Judge.

Defendant Ernest Wayne Grubbs appeals from the district court’s order denying his motion pursuant to 28 U.S.C. § 2513 for a certificate of innocence on the charge of being a felon in possession of a firearm in violation of 18 U.S.C. § 922(g)(1). For the reasons set forth below, we AFFIRM the district court’s order.
