APPEAL from an order of the Superior Court oE Yolo County setting aside a verdict. K. S. Mahon, Judge presiding. The facts are stated in the opinion of the court.
1Opinion of the CourtHart, J.
The defendant was convicted in the superior court in and for the county of Yolo of the crime of obtaining certain personal property by false and fraudulent pretenses.
At the time fixed for pronouncing the sentence or the judg ment on the verdict of conviction, the court, of its own motion, made an order setting aside said verdict on the ground that the defendant had never entered a plea to the information under which he was prosecuted and adjudged guilty.
The people, through the district attorney of Tolo County, present this appeal from said order.
