The appellant, George Meece, having been indicted for the murder of Jack Gardner, was tried and convicted of manslaughter in the Larue circuit court, and sentenced to hard labor in the state prison for twenty-one years. He is in this vcourt asking a reversal of the judgment. Upon the facts. of the record it would have been difficult to have given an instruction prejudicial to the substantial rights of the accused.
