1. The defendant in error (hereinafter referred to as the plaintiff) filed suit against the plaintiff in error (hereinafter referred to as the defendant) in the Superior Court of Gordon County. The plaintiff’s action was one at law on an alleged implied contract, and the following statement presents, in condensed form, all that is material to an understanding of the question of our jurisdiction.
