MEMORANDUM OF OPINION AND ORDER OF THE COURT

GIGNOUX, District Judge.

Joshua Groupp was found guilty by a jury of refusing to submit to induction into the armed forces of the United States, in violation of 50 U.S.C. App. § 462(a). He has now filed a timely motion for a judgment of acquittal, Fed.R. Crim.P. 29(c), on the ground that his local Selective Service Board, Local Board No. 16, Kennebunk, Maine, was illegally constituted when it classified him I-A and subsequently ordered him to report for induction.
