This is an appeal from a dismissal of a suit brought under §§ 706(f)(1) and (3) and § 707 of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-5(f)(1) and (3) and 2000e-6, in which the Equal Employment Opportunity Commission (“Commission” or “EEOC”) alleged that defendant Sears, Roebuck and Company (“Sears”) has engaged in a pattern and practice of illegal discrimination against blacks and Hispanics at its facilities in Brooklyn and White Plains.
