Peoples Wayne County Bank of Dear-born, a Michigan corporation, brought suit against John GK Harvey, the maker, and John A. Mercier, the indorser, of a promissory note for $23,866.28, dated June 15, 1932, and payable to plaintiff in 90 days, with interest. Both defendants denied liability, Harvey filing a separate notice of recoupment. Plaintiff filed a motion, accompanied by affidavits, for a summary judgment against both defendants.
