Cynthia Leone brought an action against the City of Chicago to recover damages for personal injuries she sustained when struck by an automobile during the course of a traffic stop by Chicago police. A jury concluded that Leone’s injuries were caused by the negligence of the police officer involved and, based on that negligence, found the City liable to her under the common law “special duty” exception to municipal immunity for injuries negligently caused by police officers while performing their official duties.
