MEMORANDUM AND ORDER

The plaintiff, James J. Reynolds, initiated this action against seven defendants 1 alleging, inter alia, violations of the Employee Retirement Income Security Act, 29 U.S.C. § 1132 (ERISA). Bethlehem Steel, one of the defendants, filed a motion to dismiss which was granted as to the common law breach of contract and fraud claims. This court determined that those claims were preempted by ERISA 2 (Paper No. 18).
