PIERCE, Judge.

Defendant, Dr. Thomas D. Burleigh, Jr., appeals from his sentence to probation which included a condition that defendant make a $5,000 charitable contribution. We affirm.

Defendant pled guilty and was convicted of unlawful dispensing of a controlled substance not in the course of a professional practice pursuant to §§ 12-22-310, 12-22-314, C.R.S. (1985 Repl.Vol.5) and § 18-18-105, C.R.S. (1976 Repl.Vol. 8). Defendant’s plea was in accordance with a plea agreement in which the district attorney agreed to dismiss other counts and to recommend probation. The presentencing report…
