This case is here on writ of error to a judgment in favor of the defendant in error, plaintiff below, against S. L. Fulghum and Union Indemnity Company.

S. L. Fulghum had entered into a contract with the State of Florida through the proper agency to construct or improve a certain road from Pensacola to Roberts, in Escambia County.
