MEMORANDUM AND ORDER
NEAHER, District Judge.
Plaintiff, a former employee of Firestone Tire and Rubber Company of California (“Firestone”), now residing and employed in this District, commenced this action under Title VII of the Civil Rights Act of 1964 (“Act”), 42 U.S.C. § 2000e et seq., on December 10, 1971. On the previous day, December 9, he had commenced an identical action in the United States District Court for the Northern District of California. 1 Both actions were instituted in order to protect plaintiff’s right to sue “in the appropriate Federal District Court” within 30 days of…
