RAND, G. J.

This suit was instituted by the State Highway Commission to obtain an injunction against the defendant as Secretary of State to enjoin him from certifying and printing on the official ballot for the ensuing election the ballot title and numbers of a proposed initiative measure to amend the existing Motor Vehicle Law. Although the suit was instituted in the name of the state on relation of the District Attorney of Marion County, the Attorney General appeared in the court below and demurred to the com plaint. The case is here on an appeal from an order sustaining the demurrer.
