MEMORANDUM OPINION

ROY, District Judge.

Some background information may be helpful in understanding the issues involved in this cause of action. Under the authority of Public Law 525, 79th Congress, July 24, 1946, 60 Stat. 634, the Government undertook the development of a multiple-purpose project known as the Arkansas River Project to improve the navigability of the Arkansas and White Rivers.
