Defendant, after becoming involved in an altercation during the course of which he drew a 32 caliber Colt automatic pistol from his pocket, was arrested by the State police on a charge of carrying or transporting a firearm in violation of the provisions of the Uniform Firearms Act of June 24, 1939, P. L. 872, section 628, as amended, 18 PS §4628. The defendant, represented by competent counsel, waived indictment and entered a plea of nolo contendere to the charge.
