Pending before the Court is the Motion for Summary Judgment filed by Defendants the Texas Department of Criminal Justice — Institutional Division, L.H. Beaird and J.E. Neeley (Docket Entry # 17) and the Motion for Dismissal of Summary Judgment filed by Plaintiff Frank S. Ale-man (Docket Entry # 21).
