Reversing.

The appellant, Thomas S. Dailey, instituted this action against the appellee, Lexington & Eastern Railway Company, to recover damages for an injury sustained hy him, which he claims was caused by the gross negligence of the engineer of one of its trains, while in the operation of the train. At a trial of the action, he'recovered a verdict in the sum of five thousand dollars, in damages, *670and a judgment in accordance therewith.
