Appelant, Charles Perkins, rented from John B. Steele a tract of 89 acres of land in McCracken county. At the time the lease was made, there was pending in the McCracken Circuit Court the case of A. T. Russell v. John B. Steele, wherein Russell was seeking to enforce a lien on the land in question. Appellant, Perkins, was not a party to the action, and had no knowledge thereof.
