This suit by French McCarty as administrator of Ray McCarty, deceased, to recover damages for the latter’s death, was originally brought against the Kentucky Utilities Company, the Chesapeake & Ohio Railway Company and O. N. G-arr, a locomotive engineer. Garr’s demurrer to the petition was sustained and the petition, dismis ied ás to him.
