MEMORANDUM OPINION
KISER, Chief Judge.
This matter is before the court on defendant’s objections to (1) the magistrate judge’s order denying defendant’s request for a ruling that plaintiffs designated expert is not qualified to testify to the standard of care, and (2) the magistrate judge’s report and recommendation recommending that this court deny the parties’ motions for summary judgment.
