The background of this sexual harassment case is set forth in an opinion issued on September 1, 1992, Bridges v. Eastman Kodak Co., 800 F.Supp. 1172 (S.D.N.Y.1992) (Carter, J.), with which familiarity is assumed. This action is presently before the court for consideration of various issues, as follows: (1) the impact of the non-retroactivity of the Civil Rights Act of 1991, 42 U.S.C. § 1981(a), (“1991 Act”) to the issues in this case; (2) defendants’ request under Rule 35(a), F.R.Civ.P., for an order compelling mental examinations of plaintiffs; and (3)…
