The defendant in error, plaintiff below, commenced this action in the district court of Oklahoma county to recover a certificate representing 66 shares of the capital stock of the Oklahoma Portland Cement Company, of the value of $25 per share, of which plaintiff claimed to be the owner. The pai'ties will be referred to herein as they appeared in the trial court. Plaintiff alleged that the stock sought to be recovered belonged to her, but for her convenience the stock was in the name of her husband, Henry M.
