This action for specific performance of an alleged contract for the purchase and sale of real estate situated in Garvin county was instituted by G. O. Young.
It is the theory of plaintiff that the letter of defendant received by him on May 28, 1945, offering to sell the real estate involved in this litigation on the terms thereof was unconditionally accepted by him by letter posted on the day of receipt of defendant’s ■letter and that there being no equities shown in favor of the defendant he was entitled to specific performance, which was denied by the trial judge, as a matter of right.
