The defendant has appealed from a judgment of $1,951.96, which was rendered against him for labor and materials furnished pursuant to an oral agreement of employment in the construction of a wharf on Almanor Lake.
The cause was tried by the court sitting without a jury. Findings were adopted favorable to the plaintiff.
