MEMORANDUM DECISION DENYING PLAINTIFF’S CROSS MOTION FOR SUMMARY JUDGMENT AND DISMISSING COMPLAINT

Inez Tillman (“Tillman” or “plaintiff’) commenced this litigation seeking judgment declaring her $30,158.08 unsecured claim against C. Vernon Mason (“debtor”) non-dischargeable under § 523(a)(4) of the Bankruptcy Code (“Code”). The matter before us is Tillman’s cross motion pursuant to Fed.
