Lehman Brothers, Inc. (“Shearson”), successor in interest to Shearson Lehman Hutton, Inc., sued Richard Sehulman for a declaration that certain debts owed Shearson are nondisehargeable pursuant to section 523(a)(2)(A) or (a)(4) of the Bankruptcy Code. 11 U.S.C. § 523(a)(2)(A) and (a)(4) (hereinafter title 11 of the United States Code will be called simply “the Bankruptcy Code”).
