Defendant was convicted and sentenced on three bills of indictment, Nos. 145,146, and 147, April Term, 1938, Montgomery County. True bills were found on September 8, 1938. Each contained three counts; two counts charged him with larceny, and the third with receiving stolen goods. Defendant was tried on February 5, 1940. When the Commonwealth rested he demurred to the evidence relating to two of the indictments, Nos. 145 and 146. The demurrer was overruled, but the trial court directed a verdict in his favor as to the count in each of the bills relating to receiving stolen…
