Before the court are Defendant’s Motion of the United States to Dismiss the Complaint and Brief in Support Thereof, filed pursuant to Rule 12(b)(1) or, alternatively, Rule 12(b)(6) of the Rules of the United States Court of Federal Claims (“RCFC”), *251Plaintiff’s Application to Proceed In Forma Pauperis, and plaintiffs request for a stay of garnishment.
