Plaintiff-appellee, Steven Richardson, claims that his fall and resulting injuries were the proximate result of the negligence of the defendant-appellant occupant of the premises, Ames Avenue Corporation, doing business as Phil’s Foodway. In accordance with the verdict, the district court entered judgment in Richardson’s favor. Phil’s Foodway appealed to the Nebraska Court of Appeals, asserting as its operative error that the district court erred in overruling its motion for a directed verdict made at the close of all the evidence.
