Tony Lacondra, appellant, was arrested and imprisoned in the county jail of Madison county by appellee, Otto Hermann, sheriff of said county, under a warrant issued by the Governor of this State on the requisition of the Governor of the State of Michigan. Appellant filed in the circuit court of Madison county an affidavit and petition for a writ of habeas corpus under the provisions of section 2 of “An act to revise the law in relation to fugitives from justice,” approved February 16, 1874, as amended in 1925, (Laws of 1:925, p. 414,) and again amended in 1929.
