The relator, Benjamin D. Ritholz, was arrested for purposes of extradition by respondent, Frank G. Sain, sheriff of Cook County, under authority of a rendition warrant issued by the Governor of Illinois on the requisition of the Governor of Michigan. A petition for writ of habeas corpus was filed by relator in the criminal court of Cook County to test the legality of his arrest and the writ issued, after which respondent filed a return alleging the Governor’s ■warrant.
