BAKES, Chief Justice.

This is a quiet title action between adjoining landowners to resolve a boundary dispute. Plaintiff respondent (Wells) claimed title to a certain disputed parcel of land under theories of written agreement, boundary by acquiescence and adverse possession. At the district court level both parties moved for summary judgment, and the district court denied appellant’s motion and granted respondent’s motion on the grounds of boundary by written agreement, boundary by acquiescence and adverse possession.
