On the original hearing of this case by the Court of Appeals (Helm v. Griffith, 17 Ala. App. 122, 82 South. 570), it Was held that the decree of the chancery court ordering a sale of the lot in ques tion for delinquent taxes assessed against it for 1909 by tbe city of Birmingham was a valid decree, and showed the existence of a valid lion which was an outstanding incumbrance upon the lot at the time of its purchase by the plaintiff from the defendant.
