The bill of interpleader by the clerk of the circuit court sought disposition of funds paid to him pursuant to proceedings by the city of Birmingham for condemnation of lands.
The suit was first instituted in the probate court. From the decree of that court, Mrs. Morris, appellant here, appealed to the circuit court, and the verdict of the jury assessed the damages to which defendants were entitled, “in proportion to their respective interests, for the taking by the city of Birmingham under its application for the lands therein described, at $2,250.” The amount of this judgment was paid to the…
