J. — The petitioner has been confined in the state penitentiary since 1918, under a life sentence for first degree murder. It appears, from exhibits attached to his petition, that, in April of this year, he applied to the district court of the United States for the eastern district of Washington for a writ of habeas corpus, which application was denied, on the ground that he had not first attempted to make use of the corrective judicial processes of the state courts.
