HEANEY, Circuit Judge.

Eugene C. Kirk, Sr., appeals from the district court’s 1 denial of his motion to vacate, set aside or correct his sentence pursuant to 28 U.S.C. § 2255. We affirm in part and reverse in part.

A jury convicted Kirk of one count of conspiracy to distribute and to possess with intent to distribute heroin in violation of 21 U.S.C. § 846, four counts of distributing and possessing with intent to distribute heroin in violation of 21 U.S.C. § 841(a)(1), twelve counts of using a telephone to facilitate this conspiracy in violation of 21 U.S.C. § 843(b), and one count of engaging…
