Plaintiff Damon Sutherland brings this action against his former employer, defendant Goodyear Tire & Rubber Co., claiming that defendant violated his rights under the Family and Medical Leave Act (“FMLA”), 29 U.S.C. §§ 2601 et seq., and fired him in retaliation for filing a workers’ compensation claim. Specifically with respect to his FMLA claims, plaintiff alleges that defendant improperly failed to designate two periods of absences — in January/February 2002 and April/May 2002;— as qualified FMLA leave, and then considered those absences in its…
