The plaintiff alleged that he was "the owner of certain operating rights by virtue of which he was permitted to do a transportation business by operating a fleet of trucks in Interstate Commerce"; that on or about 27 August, 1941, the plaintiff, L. E. Taylor, and the defendant, C. S. Schaub, entered into a contract the result of which was that an application was made to the Interstate Commerce Commission for approval of the transfer of the operating authority referred to from L.
